Oklahoma Faucets Paul Clement to Tackle Pharmacy ‘Middlemen’ at Excessive Courtroom

Veteran U.S. Supreme Courtroom lawyer Paul Clement has taken one other case to the excessive courtroom on behalf of Oklahoma, this time in protection of the state’s “modest” rules of “self-dealing” pharmacy middlemen often known as pharmacy profit managers.

In a petition for certiorari filed this month, Clement has requested the justices to evaluate a latest U.S. Courtroom of Appeals for the Tenth Circuit resolution that federal legislation preempts a 2019 Oklahoma statute regulating PBM enterprise practices. That call adopted a courtroom problem to the legislation filed by the Pharmaceutical Care Administration Affiliation, a commerce group representing PBMs.
